PRODUCTS

The terms 'you' and your' used throughout these terms and conditions apply to our customers. The terms 'we', ‘us’ and ‘our’ used throughout these terms and conditions apply to PACKING MACHINERY LTD.

It is the responsibility of you, the customer, to ensure that products purchased are suitable for their intended use and requirements. While we can offer help and advice via telephone or email, it is ultimately your responsibility to ensure that the product chosen is appropriate. We do not accept any liability for any issues, loss or damage suffered (of whatever kind) as a result of you purchasing a product that you consider does not meet your requirements.

DESCRIPTIONS

Dimensions, information and specifications listed on this website are given in good faith and are for guidance only. As products evolve or manufacturing processes change over time, these descriptions may not match 100% with the final delivered products. We try our best to keep our descriptions up to date and as accurate as possible. If you have any doubt about the description of an item, please contact us for more information.

Prospective buyers should rely on their own inspection. Whilst every effort is made to satisfy customer’s requirements, we do not represent any article we offer as being suitable for any particular purpose. Buyers must satisfy themselves that the article is fit for their intended purpose. You are therefore strongly advised to inspect all equipment prior to concluding a sale.

PAYMENT

Prices quoted are exclusive of VAT, which will be charged at the current rate in force on the date of sale. Prices are subject to change without notice. Any written quotation is valid for 30 days from the time of writing unless otherwise stated.

We reserve the right to amend quoted prices before and order is placed if our supplier(s) notify a cost change.

Online payments are processed by Shopify through their secure payment facility. We have no control over the payment process as this is dealt with entirely by a third-party system.

We are also happy to accept payment via cheque or bank transfer. Please make any cheques payable to PACKING MACHINERY LTD and send to the address details on our contact page. If you would like to pay via bank transfer, please contact us for details and we will issue the pro-forma invoice accordingly which will contain the necessary banking and payment information.

No items will be dispatched until payments have cleared in full. Please note that paying via cheque or bank transfer will increase the overall lead time on receiving your products.

PURCHASING

You will receive an order confirmation by email, it does not indicate that a contract exists between us. We reserve the right to refuse a sale based on stocking errors, last minute cost changes or for a variety of other reasons and factors. In the case of a change of price, you will be contacted in order to accept or decline the price change.

Quotations, price lists or other material published by us do not constitute offers.

LIMITATION OF LIABILITY

In the event that a product is faulty, the limit of our liability to you will be a full refund to the cost of the product only. In no circumstances whatsoever shall we be liable to you for any other losses that you consider you may have suffered the buyer or their agent(s) whether for breach of contract, in tort (including but not limited to negligence), breach of statutory duty, breach of warranty or otherwise for loss of profit, loss of use, loss of business, loss of goodwill, loss of contracts or for any other economic, financial or monetary loss whatsoever that may be suffered by you the buyer for any other indirect or consequential loss whatsoever.

We will not be under any liability whatsoever for non-performance of its obligation, in whole or part, as a result, directly or indirectly, of any strike, lock out, fire, flood, inability to obtain material, breakdown, delay, war, insurrection, government act or regulation or any other cause (whether or not of a like nature) beyond our control. 

SHIPPING

We currently ship to the United Kingdom mainland. For shipping elsewhere, please contact us for details.
We usually send our items via TNT, DHL, Parcelforce and Royal Mail, however we may choose another courier without notice.

Please note that all delivery estimates and lead times given are estimates. Generally speaking, items in stock are dispatched 1 – 2 working days after cleared payment. Items out of stock or limited stock items may take substantially longer unless stated otherwise.

We give no guarantees on exact delivery times. Where delivery will be longer than the estimated period given, we will advise prior to processing the order. Where a product is not in stock, we will advise before dispatch.

We are no longer responsible for the items once they have been dispatched to the relevant courier.

DAMAGES

If your items arrived either damaged or faulty, please contact us within 48 hours or receipt. If your goods are damaged in transit, a claim can be made against the carrier. Providing we have been made aware within 2 days of receipt if your item that there is a problem, you will be sent instructions on sending back the damaged goods, and a replacement will be sent. The cost of return postage is payable by you. We suggest that you use a recorded delivery method as we cannot be held responsible for any losses or damage incurred in transit back to us.

If Goods are accepted from a carrier without prior checking, or signed for 'unexamined', no claim whatsoever can be accepted by us. It is the responsibility of the buyer or their agent(s) to inspect the goods, sign the delivery note accordingly and where applicable inform us immediately of any alleged damage or shortages. We have no liability for any damage caused during off-loading.

No claim for damage in transit or shortage in delivery will be considered unless immediate notice is given verbally and in writing both to the carrier and to us within two days of receipt of the goods, followed by a more detailed claim within ten days of receipt of the goods. No goods returned to us or will be accepted without prior written authorisation. A breach of these conditions shall debar the buyer from making a claim.

We do not cover faults caused by accident, neglect, misuse or normal wear and tear.  Consumable items, such as element wires, Teflon, cutter blades, pressure pads and fuses are not covered. Damaged equipment should not be used until it has been inspected or repaired by a competent person.

GUARANTEE

All products advertised on this website and sold within the UK mainland have a commercial warranty of 1 year, unless stated otherwise, products sold to areas outside of the UK mainland (or shipped to by others) have a commercial parts only warranty of 1 year, additional carriage may apply in these circumstances.  

Our warranty does not cover any wearing parts. The warranty covers any non-wearing part for genuine mechanical or machine failure. Parts will not be covered if they fail or break due to human or environmental factors such as misuse, neglect, dirt, water, cold, heat etc.

Regular maintenance is essential if the equipment is to operate as specified. Any failure of the equipment through the lack of maintenance within the first twelve months of the purchase may render the necessary repairs chargeable and the customer will not be able to rely on normal warranty conditions. We do not undertake to pay for the cost of the carriage charges involved in returning the product to us.

PRIVACY POLICY

We do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment.

 Cookies are used on this website where they are strictly necessary for the site functionality. They are used to aid navigation, and to keep track of the contents of your shopping cart. If you log in to an account, your logged-in status is recorded in a temporary cookie. You can turn off cookies by blocking them in your browser Privacy settings. If you turn off cookies, you may be unable to place orders or benefit from the other features that use them.

Data collected by this site is used to:

Take and fulfil customer orders.

Administer and enhance the site and service.

Advise you on special offers and new products, provided you have subscribed to newsletters.

We only disclose information to third-parties for goods delivery purposes.

RETURNS POLICY

You have the right to cancel your order within 14 days of receipt of products from us. We will gladly take back wrongly purchased or unsuitable items provided that you return the goods to us in a perfect and resalable condition. You are responsible for returning the products to us and for any costs involved. We expect the goods to return in the exact condition that they were originally dispatched.

We may charge a restocking or repair fee for any items returned unclean, damaged, faulty, with damage to packaging, parts missing, manuals or documents missing, incorrect packaging or not ready for re-sale. The restocking fee can be up to 25% or the original sale value.

The goods to be returned must be unused and well packed in their original packaging. We do not refund your original order postage cost, and the cost of return postage is payable by you. We suggest that you use a recorded delivery method and with insurance for high cost items, as we cannot be held responsible for any losses or damages incurred in transit back to us.  

Refunds and exchanges will not be processed until returned goods have been examined, if following return goods are in an unfit state then we reserve the right to refuse any refund or exchange and invite the customer to collect their goods.

If you cancel an order for an item of equipment which has been specifically made to your requirements, you will be liable, in addition to the above, to bear the costs of converting the equipment to standard specification. Where the said item cannot be converted then the you will be liable for the cost of manufacture up to the time of cancellation, as well as the liabilities outlined in the paragraphs above.

REMITTANCE TERMS

Our standard terms for the sale of equipment are strictly payment prior to despatch unless otherwise agreed. An interest charge of 1.5% per month will be made on all invoices not paid by the due date. We reserve the right to vary the rate of interest charges.

Title of the goods passes to the buyer when we have received payment in full.

Upon delivery of the goods to the buyer or its agent(s) all risk in the goods passes to the buyer. Where applicable until full payment has been made. The buyer holds the goods in trust for us and is responsible for keeping the goods separate from any other assets and in a state of good repair. All goods remain the property of us until invoices are paid in full.

The customer shall remain a bailee only until full payment is made Where applicable no retentions will be applicable without our prior and express agreement.

COPYRIGHT NOTICE

This Website and its contents are protected by international laws. All images, text, audio and video and other materials appearing on the Website (the Content), and the arrangement thereof, are the property of PACKING MACHINERY LTD or its affiliates, and are protected by international copyright and other laws.

None of the Content may be copied, reproduced, transmitted or distributed without the prior permission of PACKING MACHINERY LTD.

APPLICABLE LAW

The construction validity and performance of any contract between PACKING MACHINERY LTD and the buyer shall be in accordance with English Law.
